Power of Attorney
To simplify the process, you may choose to grant your solicitor a Power of Attorney (POA).
This allows them to act on your behalf throughout the transaction, significantly reducing the need for travel to Portugal. In most cases, you would only need to attend key milestones, such as collecting the keys to your new home.
Your solicitor will prepare and notarise all required documentation, ensuring a smooth and efficient process from start to finish.
Thorough Due Diligence
Your solicitor begins with comprehensive due diligence to fully verify the legal status of your chosen property. This includes confirming ownership through land registry checks, identifying any debts, liens, or encumbrances, and reviewing all relevant records with the Tax Office and local authorities.
They will also verify habitation licences, utility connections, and any community or condominium obligations where applicable.
In addition, your solicitor assists with essential administrative steps such as obtaining your Portuguese tax number (NIF) and opening a local bank account, ensuring a smooth transition into the Portuguese system.
Contracts & Completion
Once all legal checks are complete, your solicitor prepares the promissory contract (Contrato de Promessa de Compra e Venda) and coordinates the signing process. Where applicable, they also integrate mortgage documentation from your lender.
Your solicitor manages communication between all parties, including vendors, lenders, and the notary, to ensure a smooth and coordinated transaction.
On completion day, they oversee the signing of the final deed (Escritura de Compra e Venda) and ensure all documents are properly executed and translated into English where required.
For new-build or off-plan properties, they ensure your payments are protected through bank guarantees, safeguarding your investment in the event of any contractual issues.
Following completion, your solicitor registers you as the legal owner with the land registry and Tax Office, ensuring all records are accurately updated in your name.
